Durian Party Terms and Conditions

The Client hereby agrees to engage Newleaf to provide the Client with the following products and services as per the booking form.
Products:
i. Fresh Durian
ii. Durian Truffle Chocolate (Optional)
iii. Butter Cookies Durian Ice Cream (Optional)

Services:
i. Delivery
ii. Newleaf Crew(s) Catering Service (Optional)
iii. Disposal of durian shells (Optional)

  1. Pricing Information
    1. Please note all durian prices are not fixed and are based on seasonal price. Therefore, a quotation with the final price will only be issued to you 3 days before the delivery date. We reserve the right to make final adjustment on the price.
  2. Order
    1. We accept booking/order on Monday to Friday between 10:00 am to 5:00 pm. Booking/order must be made 3 – 5 days prior to the delivery date.
    2. You can contact us to ask for durian availability before the day of the delivery date but we reserve the right to refuse to fulfill any order if durians are unavailable or the delivery area is not covered. Last minute order will only be considered based on product availability and within our range of service.
    3. By placing a booking/order, you must complete and submit the booking form with accurate and up-to-date information.
    4. All bookings/orders are subject to acceptance by us, and we will confirm your order by sending an email to you as a confirmation of order/booking.
    5. It is your responsibility to review the details of your booking/order and notify us of any omissions or corrections.
  3. Services
    1. The order is to be delivered to the client’s address as per the booking form.
    2. Clients can request Newleaf crews to provide durian catering services such as opening durians, packing durians to food containers or plates, and disposing of durian shells. Charges will be imposed for this service.
  4. Delivery
    1. Newleaf is agreeable to providing such durian deliveries and services to the client based on the terms agreed by both parties.
    2. Delivery fee will be applied according to areas.
    3. Deliveries may arrive earlier prior to your requested delivery time.
  5. Order Cancellation
    1. We accept free cancellation if notice is made up to 48 hours prior to the event. The refund will be credited to the bank account provided by you, subject to the respective Financial Institution to arrange the refund. 100% deposit will be forfeited if the cancellation is made within 48 hours before the event.
    2. We shall aim to let you know, using the contact details that you have provided to us if we are unable to meet our estimated delivery date and delivery location due to but not limited to the unavailability of the Product and/or any occurrence of any Force Majeure events, including any technical or operational issues. In such circumstances, we may also arrange for the order cancellation and a full refund for you.
  6. Payment
    1. Payment can be made by credit/debit card, online bank transfer (FPX), or eWallets which are acceptable by us.
    2. We request a 50% deposit to lock your booking in and full payment made 1 day prior to the delivery date.
  7. Exchange
    1. The Customer has the right to inspect the Product(s) for any obvious faults, defects, or damage before the Customer accepts and receives the Product(s). If you are unsatisfied with your Product(s) before or after the acceptance of the Product(s), you may arrange an exchange. However, we reserve the rights not to accept any requests for exchange and retain the discretion not to provide a reason for our decision. Exchange of a Product will be subject to Newleaf’s evaluation.
    2. 7.2 Without prejudice to the foregoing, we reserve the right to decline the exchange requests, for any of the following reasons: –
      (a) Customer’s subjective view or/and taste preference;
      (b) Expectation on appearance of Product(s);
      (c) Quality deterioration of Product(s) due to Customer’s human error including but not limited to Customer’s negligence, abuse, misuse, accidents, or alterations.
      (d) No photography or video recording of the original Product(s) as evidence or/and the Product(s) has been disposed of;
      (e) Not informing Newleaf during your event time after accepting and receiving the Product(s); and
      (f) Customer’s failure to accept the Product(s) upon delivery without contacting Newleaf at the very soonest and arranging with us for an alternate delivery time on the same day after the Product(s) is ready for delivery. The Order may be deemed cancelled and Newleaf reserves the right to forfeit any amounts paid for the Product(s).
    3. 7.3 Please note if the Newleaf crews are servicing you during the event, you can request for exchange immediately subject to their evaluation. We will prepare contingency amount of durian in case of unforeseen circumstances.
    4. 7.4 It is your responsibility to ensure that the products are sufficient and suitable for your purposes and meet your individual requirements. We do not warrant that the Products will meet your individual requirements. You acknowledge that the products are standard and not made bespoke to fit any particular requirements that you may have.
  8. 8. Other
    1. 8.1 We do not help to dispose of the durian shells if we only provide delivery service. If the Newleaf crews are providing durian catering service during the event, they will help with disposal of the durian shells.
    2. 8.2 Newleaf reserves the right to change these terms and conditions at any time without prior notice. Please check the latest terms and condition with Newleaf official representatives.
